AB  - The problems discovered in the process of obtaining experiences from the application of the Bankruptcy Act, No. 328/1991 Gazette in the Czech Republic are of very specific nature in some fields of the economy and especially in the agriculture. The paper deals with problems connected with the property denominated as inventory of bankruptcy estate when bringing an action before courts. Further on, it deals with relationship between the property in bankruptcy estate and claims from proprietary restitution brought against this property according to the Property Restitution Act, No. 403/1990 Gazette, especially in agriculture.
